3. What is personal data?

Personal data is defined by the General Data Protection Regulation (EU Regulation 2016/679) (the "GDPR") and the Data Protection Act 2018 (collectively, "the Data Protection Legislation") as "any information relating to an identifiable person who can be identified directly or indirectly, in particular by reference to an identifier".

Personal data is, in simpler terms, any information about you that allows you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data and other online identifiers.

The personal data we use is described in section 5 below.

4. What are my rights?

Under data protection legislation, you have the following rights, which we will always endeavour to uphold:

The right to be informed about our collection and use of your personal data. This privacy notice should tell you everything you need to know, but you can always contact us to find out more or to ask questions using the details in part 11.

a) The right to access the personal data we hold about you. Section 10 will explain how to do this.

b) The right to have your personal data rectified if any of your personal data held by us is inaccurate or incomplete. Please contact us using the details in section 11 to find out more.

c) The right to be forgotten, i.e. the right to ask us to delete or otherwise dispose of your personal data held by us. Please contact us using the details in part 11 to find out more.

d) The right to restrict (i.e. prevent) the processing of your personal data.

e) The right to object to our use of your personal data for specific purposes.

f) The right to withdraw consent. This means that, if we rely on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time.

g) The right to data portability. This means that, if you have provided us directly with personal data, we use it with your consent or for the performance of a contract, and the data is processed by automated means, you can ask us for a copy of that personal data for re-use with another department or company in many cases.

h) Rights relating to automated decision-making and profiling. Part 6 explains in more detail how we use your personal data, including automated decision-making.

For more information about our use of your personal data or exercising your rights as set out above, please contact us using the details provided in section 11.

It is important that your personal data is accurate and up to date. If any of the personal data we hold about you changes, please let us know as long as we have this data.

Further information about your rights can also be obtained from the Information Commissioner's Office (https://ico.org.uk/) or your local Citizens Advice Bureau.

If you have a complaint about our use of your personal data, you have the right to complain to the Information Commissioner's Office. However, we would welcome the opportunity to resolve your concerns ourselves, so please contact us first, using the details in Part 11.

Depending on your use of our site, we may collect and store some or all of the personal data described in the table below, using the methods also described in the table. We do not collect "special category" or "sensitive" personal data, personal data relating to children or data relating to criminal convictions and/or offences.

We use the following automated system to carry out certain types of decision-making and profiling. If at any time you wish to question an action we take on the basis of this or if you wish to request "human intervention" (i.e. someone to review the action themselves, rather than relying solely on the automated method), data protection legislation gives you the right to do so. Please contact us to find out more using the details in part 11.

We will only use your personal data for the purpose(s) for which it was originally collected, unless we reasonably believe that another purpose is compatible with that original purpose(s) and we need to use your personal data for that purpose. 7. How long will you keep my personal data?

We will not retain your personal data for longer than is necessary for the purpose(s) for which it was first collected. Your personal data will therefore be retained for the following periods (or, in the absence of a specified period, the following factors will be used to determine the retention period):

8. How and where do you store or transfer my personal data?

We will store or transfer some of your personal data in the UK to the extent that digital technology permits. We endeavour to comply with data protection legislation to the best of our ability.

In addition, we may store or transfer some of your personal data within the European Economic Area (the "EEA"). The EEA includes all EU Member States plus Norway, Iceland and Liechtenstein. This means that your personal data will be fully protected under data protection legislation, the GDPR and/or equivalent standards by law.

We may also store or transfer some or all of your personal data in countries outside the European Economic Area (the "EEA" includes all EU Member States plus Norway, Iceland and Liechtenstein). These countries are known as "third countries" and may not have data protection laws as strict as those of the UK and/or the EEA. This means that we will take additional steps to ensure that your personal data is processed as safely and securely as it would be in the UK and under data protection legislation.

When we transfer your data to a third party based in the United States, the data may be protected if it is part of the EU-US Privacy Shield. This obliges the third party to provide data protection at levels similar to those in Europe. Further information is available from the European Commission.

Please contact us using the details below in section 11 for more information on the specific data protection mechanisms we use when transferring your personal data to a third country.

The security of your personal data is essential to us and to protect your data we take a number of important steps, including the following:

  • limit access to your personal data to employees, agents, sub-contractors and other third parties with a legitimate need to know and ensure that they are subject to confidentiality obligations;
  • procedures for dealing with data breaches (accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access to your personal data), including notifying you and/or the Information Commissioner's Office where we are legally required to do so.

9. Do you share my personal data?

We will not share any of your personal data with third parties for any purpose whatsoever, subject to the following exceptions.

If we sell, transfer or merge parts of our business or assets, your personal data may be transferred to a third party. Any new owner of our business may continue to use your personal data in the same way as we have used it, as specified in this privacy policy.

In certain limited circumstances, we may be legally required to share certain personal data, which may include yours, if we are involved in legal proceedings or if we are complying with legal obligations, a court order or instructions from a government authority.

10. How can I access my personal data?

If you want to know what personal data we hold about you, you can ask us for details of that personal data and a copy of it (where it is held). This is known as a "subject access request".

All requests for access to the subject must be made in writing and sent to the e-mail or postal addresses indicated in section 11.

There is normally no charge for a subject access request. If your request is "manifestly unfounded or excessive" (for example, if you make repetitive requests), a fee may be charged to cover our administrative costs of responding.

We will respond to your request for access subject to verification of identity within 10 working days and in any event no later than one month after receipt. We will normally endeavour to provide a full response, including a copy of your personal data, within this period. In some cases, however, particularly if your request is more complex, additional time may be required up to a maximum of three months from the date of receipt of your request. You will be kept informed of our progress.
